# RESIDENTIAL LEASE AGREEMENT

This Residential Lease Agreement ("Agreement") is made and entered into on **September 1, 2026**, by and between **Marisol Vega** ("Landlord") and **Daniel Okafor** ("Tenant").

## 1. Premises

Landlord hereby leases to Tenant the residential premises located at **428 Maplewood Avenue, Apartment 3B, Hartsdale, NY 10530** (the "Premises"), together with one assigned parking space (Space #14) and access to shared laundry facilities in the basement.

## 2. Term

The term of this lease shall be **twelve (12) months**, commencing on **September 1, 2026** and ending on **August 31, 2027**, unless earlier terminated in accordance with this Agreement. This lease shall not automatically renew; any renewal must be agreed to in writing by both parties at least sixty (60) days before the end of the term.

## 3. Rent

Tenant shall pay Landlord monthly rent of **$2,350.00**, due on or before the **first (1st) day of each calendar month**. Rent shall be paid by check, bank transfer, or through the online payment portal designated by Landlord. The total rent payable over the full term of this Agreement is **$28,200.00**.

## 4. Late Fees

If rent is not received within five (5) days of the due date, Tenant shall pay a late fee of **$50.00**.

## 5. Security Deposit

Upon execution of this Agreement, Tenant shall deposit with Landlord the sum of **$2,350.00** as a security deposit. The deposit shall be held in an interest-bearing account as required by New York law. Within **fourteen (14) days** after Tenant vacates the Premises, Landlord shall return the security deposit of **$2,350.00**, less any lawful deductions, together with an itemized statement of any amounts withheld.

## 6. Utilities

Tenant shall be responsible for electricity, gas, internet, and cable. Landlord shall be responsible for water, sewer, trash collection, and snow removal from common areas. Heat is included in rent as provided in Section 9 below.

## 7. Occupancy

The Premises shall be occupied solely by Tenant and the following named occupants: *(none)*. Guests staying more than fourteen (14) consecutive days require Landlord's prior written consent.

## 8. Pets

No pets shall be kept on the Premises without Landlord's prior written consent. If consent is granted, Tenant shall pay a one-time non-refundable pet fee of **$300.00** and additional pet rent of **$50.00** per month.

## 9. Maintenance and Repairs

Tenant shall keep the Premises clean and sanitary and shall promptly notify Landlord of any condition requiring repair. Landlord shall maintain the structural elements, plumbing, electrical, and heating systems in good working order. Tenant shall be responsible for the first **$50.00** of any repair caused by Tenant's misuse or neglect. Tenant shall not make alterations, paint, or install fixtures without Landlord's prior written consent.

## 10. Entry by Landlord

Landlord may enter the Premises with at least **twenty-four (24) hours'** advance notice to Tenant, and only between 9:00 a.m. and 7:00 p.m., except in cases of emergency, in which case no notice is required.

## 11. Insurance

Landlord's insurance does not cover Tenant's personal property. Tenant is required to maintain renter's insurance with a minimum personal liability coverage of $100,000 throughout the term and to provide proof of coverage upon request.

## 12. Termination and Notice

Either party may decline to renew this Agreement by providing written notice at least **sixty (60) days** prior to the end of the term, as described in Section 2. Early termination by Tenant requires payment of an early termination fee equal to **two (2) months' rent** and forfeiture of the security deposit, except as otherwise required by law.

## 13. Subletting and Assignment

Tenant shall not sublet the Premises or assign this Agreement without Landlord's prior written consent, which shall not be unreasonably withheld for sublets of the entire Premises as provided under applicable New York law.

## 14. Quiet Enjoyment

Tenant shall be entitled to quiet enjoyment of the Premises. Tenant shall not disturb neighboring residents, and quiet hours shall be observed between 10:00 p.m. and 7:00 a.m.

## 15. Smoke Detectors and Safety

Landlord shall provide working smoke and carbon monoxide detectors as required by law. Tenant shall test detectors monthly, replace batteries as needed, and shall not disable any detector. Tenant shall notify Landlord immediately of any malfunction.

## 16. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the **State of New York**, and any disputes arising hereunder shall be resolved in the courts of Westchester County, New York.

## 17. Entire Agreement

This Agreement, together with any attached addenda, constitutes the entire agreement between the parties and supersedes all prior negotiations and understandings, whether written or oral. Any modification must be in writing and signed by both parties.
